Is virtual drug testing legally defensible?

Yes. Live-witnessed virtual collection has been recognized as a legally valid collection method under both DOT 49 CFR Part 40 (for federal testing) and standard employer drug testing programs. Our chain of custody — including video recording, e-signatures, and tamper-evident sealing — has been designed to meet or exceed the documentation standard of traditional on-site collection. Every collection is observed by a certified collector, recorded, and time-stamped.

The donor is observed on camera from before the collection begins until the specimen is sealed. The collector verifies the donor’s identity against their government ID, confirms the donor’s mouth is clear before swabbing, and watches the entire swab collection without interruption. Cheating in a live-witnessed virtual collection is no more feasible than in a traditional on-site collection.
Rapid non-negative results are automatically routed for laboratory confirmation at our SAMHSA-certified lab partner. The specimen is shipped via FedEx in a tamper-evident pouch, accessioned at the lab, and analyzed by LC-MS/MS at industry-standard cutoffs. Confirmed results are returned to your dashboard within 24-72 hours and (if enabled) reviewed by a Medical Review Officer before release.
In many cases, yes. We integrate with most major TPAs and workers’ comp carriers. During the demo, we will ask which TPA you work with and confirm our compatibility — and if there’s an integration we have not yet built, we will discuss timing.
We maintain a current compliance matrix for all 50 states and the District of Columbia. State-specific requirements — including marijuana protection laws, notice requirements, and procedural rules — are built into your dashboard and applied automatically when you create an order. If a particular test type is restricted in your state, we will tell you.

Swab Now is currently launching with non-DOT employer testing. DOT-regulated oral fluid testing is on our roadmap and will be available in the near future. The donor needs a smartphone with a camera, an internet or cellular connection, and a valid government-issued ID. The video collection runs in a standard mobile browser — no app installation required. For donors who do not have a smartphone, our 24/7 hotline provides a voice-first fallback that can be paired with the supervisor’s phone for video.
We are HIPAA-compliant from day one. Business Associate Agreements are in place with every vendor in our stack, including our video provider, lab partner, and identity verification provider. All PHI is encrypted in transit and at rest. Access is role-based and audited. We do not share data with third parties beyond what is necessary to deliver your test results.
We offer month-to-month pricing for smaller employers and annual contracts for organizations that prefer to lock in volume pricing. There is no minimum test volume to get started. We recommend discussing your specific testing volume during the demo so we can recommend the right plan.
For small employers, you can be running tests within a few business days of signing. For larger organizations with HRIS integrations or custom requirements, implementation typically takes 2-6 weeks. We assign a dedicated implementation manager to every customer regardless of size.
